Vehicle Jump Start

Security Services offers a free jump starting service for vehicles on campus property. The following apply when requesting this service:

• Personal identification must be provided.
• A waiver releasing the College from liability must be completed.
• If security personnel are unable to assist you, or if their attempt fails, they can place a call to a local tow service at your expense.

Vehicle Jump Start Liability Waiver

I, the undersigned, do hereby acknowledge and agree to the following:

1. Risks: I understand that jump starting a vehicle carries inherent risks, including, but not limited to, electrical sparks, fires, explosions, and damage to the battery, electrical system, or other components of the vehicle. I also understand that personal injury may occur during the jump start process.
2. Assumption of Risk: I assume full responsibility for any and all damage or injury caused to myself, my vehicle, or any other person or property as a result of the jump start service.
3. Waiver of Liability: In consideration of Carleton College providing a free jump start service to my vehicle, I hereby release, waive, discharge, and agree to hold harmless Carleton College, its officers, employees, agents, and volunteers from any and all liability, claims, demands, losses, or damages, including, but not limited to, personal injury, property damage, or death, arising out of or in any way connected with the jump start service, regardless of whether such liability arises from the negligence, gross negligence, or intentional misconduct of Carleton College, its officers, employees, agents, or volunteers.
4. Indemnification and Hold Harmless: In further consideration of my being permitted to participate in the jump start service, I, for myself and for my executors, personal representatives, heirs and assigns, hereby assume full responsibility for the risks, foreseen or unforeseen, of property damage, injuries, or death to myself or to others arising out of my participation. I agree to indemnify and hold harmless Carleton College, its Trustees, officers, faculty, students, employees and/or agents from all claims, demands, damages, costs, expenses, actions and causes of action, present or future, including but not limited to costs of medical treatment and reasonable attorneys’ fees, that may accrue to any person or entity as a result of any property damage, injuries, or death, caused by me or arising out of my participation in the service.
5. Inspection: I acknowledge that I am solely responsible for ensuring that my vehicle is in a safe condition to be jump started. I will notify Carleton College’s representative of any known issues with my vehicle’s battery or electrical system before the jump start service is performed.
6. Right to Refuse Service: Carleton College reserves the right to refuse to provide jump start service to any vehicle if, in its sole discretion, it believes that doing so could pose a safety risk.
7. Acknowledgment of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to bring legal action or assert a claim against Carleton. I acknowledge that by signing below, I am signing the agreement freely and voluntarily and effecting a complete and unconditional release of all liability to the greatest extent allowed by law.
